Privacy and Security on the Public Site

menMD understands that privacy of information is of great importance to our customers and the people that visit our site. We want you to know that menMD does not sell information obtained through use of this website to anyone. In addition, we have established the following privacy and security practices with respect to the public portions of menMD websites and mobile applications.

Because we want menMD websites and mobile applications to better serve visitors’ needs, we collect some basic information about visitors’ computers, including:

  • Operating system (e.g. Windows 10)
  • Browser software (e.g. Microsoft Edge, Google Chrome, Safari, Firefox)
  • Internet Service Provider (e.g. AOL)

The information we collect about our visitors’ computers will not be used to identify individuals. Instead, we check which Web pages and services people use while they are here. For example, we use the browser information to help us design our website so that as many people as possible will be able to view the pages correctly. Privacy and Security on the Secured Sites

The sections of menMD websites and mobile applications that are password protected and require individuals to register and login, contain protected health information (PHI) and allow individuals to perform certain transactions. Because of this menMD must be able to link a user’s activity back to their identity. For example, when a customer changes his doctor, we must be able to make that change within our systems and we cannot do that without linking the information back to the customer. In addition, it is important for menMD to keep track of what functionality a customer uses. Therefore, in the password protected portion of our website, menMD does collect identifiable information about users. This includes information about the user’s computer as listed above, and information related to the user, such as pages visited and PHI submitted or changed.

The confidentiality, integrity and availability of your PHI are important to menMD. To protect against unauthorized access to PHI that is accessible on the password-protected portions of our site, menMD has adopted stringent security standards.

PHI that menMD collects from users on the password-protected portions of menMD websites and mobile applications is confidential. All PHI menMD has regarding our customers is available only to authorized users and is protected from unauthorized access by multiple layers of security controls and monitoring.

We collect email addresses as part of the registration process. We will use email addresses to notify registrants of online activity related to the security and privacy of their accounts, such as, retrievals of username, etc. In addition we will use email addresses to send customers health and wellness information and other updates that might be of interest to them as customers of menMD. On certain occasions we may also share email addresses with providers in our network so that they may send you information that describes health-related products and/or services offered by the provider. Each time we or any such provider sends health and wellness information and other updates, the recipient will be given the opportunity to opt-out of receiving similar emails in the future. Please note that registrants cannot opt-out of receiving emails that notify them of online activity since these are necessary to protect the privacy and security of Web accounts.

Cookie Policy & CCPA (California Consumer Privacy Act)

This website uses web analytics tools to help analyze how users use the site, for advertising purposes and to help improve visitors’ experiences on our websites. These tools use “cookies,” which are text files placed on your computer, to collect standard Internet log information and visitor behavior information in an anonymous form. Shine the Light Disclosure. California’s Shine the Light Act is a consumer privacy law passed in 2003. It requires businesses to disclose, upon the request of a California resident, what personal information about that person the business has shared with third parties, and which third parties received the personal information. menMD does not share your personal information with third parties for their own direct marketing purposes.

menMD shall not have any liability or responsibility for any errors or omissions in the content of this program. menMD does not represent or warrant that the Rx Alerts text messaging program will operate without interruption or error.

In no event shall menMD, its affiliates or any of their employees, directors, officers, agents, vendors or suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with participation in this program, whether in contract, negligence or other tortious action, even if an authorized representative of menMD has been advised of or should have known of the possibility of such damages. In jurisdictions which do not allow the exclusion or limitation of liability for incidental or consequential damages, such limitation shall not be applicable to you.

Your participation in Rx Alerts is at your sole risk and if you are dissatisfied with the text messaging program, its content or with these terms and conditions, your sole and exclusive remedy is to opt out of the program.

Waiver

No term or provision of these Terms and Conditions shall be deemed waived and no breach excused unless such waiver or consent is in writing and signed by the party claimed to have waived or consented.

Termination

menMD reserves the right, in its sole discretion, to terminate your access to Rx Alerts, with or without notice, for any reason or no reason, including, without limitation, your violation of these Terms and Conditions.

Governing Law and Venue

By accessing and using Rx Alerts, you agree that your access and use is subject to these Terms and Conditions as well as applicable laws, as governed and interpreted pursuant to the laws of the State of Florida. Any litigation arising out or in connection with your use of this Program shall be exclusively in the state or federal courts located in Pinellas County, Florida.

Severability; Entire Agreement

If any part of this agreement is ruled to be unenforceable, then such part shall be limited or eliminated to the minimum extent necessary, with the remainder of agreement remaining in full force and effect. These Terms and Conditions constitute the entire agreement between us governing your use.
